I was wondering if we had decided on a second Observer's training? Thanks

Post here if you have any specific, Occupy Albany related questions for the legal working group and we will get back to you as soon as we can.

i'm with Human Resources WG and we had a question about the legality of outdoor cooking in the park. some suggestions were to have propane burners for soups and grilling on site. we decided to table further discussion until we ran it through you folks. thanks.

There isn't anything in the law or regulations that prohibits propane burners, grilling, open flames, etc., so I can prospectively say that we can us propane burners, but give us until Thursday morning to let this question ruminate before taking any concrete action. There may be some idiosyncratic rule or regulation floating around out there that would be relevant here that I don't know about but which might be known to others in the group.

No. RICO only applies to "enterprises" committing a certain number of gang-ish like crimes like extortion, prostitution, bribery etc. (that we would never commit) in a defined time period. There's some precedent for using this against activists (http://www.greenisthenewred.com/blog/mob-law-i-69-environmental-activists/1804/), but it's not anything we need to worry about. en.wikipedia.org/wiki/Racketeer_Influenced_and_Corrupt_Organizations_Act

As far as kitchen supplies go, are there any regulations that we should be aware of (e.i. having kitchen knives for chopping veggies, silverware, glass plates, etc)? Somebody brought up this concern at a Humane Resources meeting. Please clarify. Thank you!

I did some more research regarding the use of utensils, and I could find nothing in the code prohibiting the use in parks, etc. But if someone else from legal finds something that I missed please respond as well.

Absolutely no law training whatsoever.
I was at the park most of the day, and before I left to go get some rest, the question of whether or not we would be allowed to stay and camp out in Lafayette park was still up in the air. Now, I personally am not equipped to be able to spend the night, but I was mulling the problem over and something occurred to me:
How would it be if the O.A. movement issued a "lights out" at 11pm? That is, what if everyone who had the intention of staying the night was already in their tents and theoretically asleep by the time the police came to check on things to try and enforce the curfew? I could be completely off base here, but it seems to me that it would be more than a little problematic for the authorities to try to barge into people's tents in an effort to drag them out and send them home. My gut tells me that could lead to some truly unpleasant embarrassments and possible legal snafu's for the police, but again, I am no law expert, I'm not even a law novice.
Anyone who knows what the potential consequences of such an action would be, please chime in. If it the "lights out" idea is something that could help keep us occupying full time, then by all means, someone take it and run with it. I'm too new at this to have a clue what to do with it besides throw it out there.
Peace! ~Erica

Without legal training...
I would like to know the parameters of using sound amplification, including a PA system, in the park. We're planning a concert and rally for Saturday Nov. 5th and would like to know how much power we can/can't use under Albany Code enforcement. Hours of possible operation (curfews) would be helpful also.
Please send any findings to me via email: scatsapien@gmail.com
Thanks.
